Terms of Service
1. Who we are and what these terms cover
Atune is provided by Krohn Investering AS, org.nr. 928 658 198, Kjerrheibakken 52B, 4621 Kristiansand, Norway ("Atune", "we").
These terms apply between Atune and the business that creates an Atune workspace ("Customer", "you"). They cover use of the Atune app, the SDK, the API, the MCP connector and the documentation ("Service").
The Data Processing Agreement ("DPA") at useatune.com/dpa is part of these terms. It governs the personal data you send to Atune about your own users. If these terms and the DPA conflict on data protection, the DPA prevails.
If a translation of these terms differs from the English version, the English version prevails.
2. Business use only
The Service is for businesses and people acting in a professional capacity. By accepting these terms you confirm that you act on behalf of a business and have the authority to bind it. Consumer protection law for private consumers does not apply to the agreement between you and Atune.
3. Your account
- You sign in through our authentication provider (Clerk). Keep your sign-in details safe. You are responsible for activity in your workspace.
- The person who creates the workspace is its owner. The owner and admins can invite others, who then see the workspace's data. Only the owner can change the plan and delete the workspace.
- Give us correct contact details and keep them current. We use them for service and billing messages.
4. The Service
- Atune receives product-usage events that you send with the SDK, the API or an import. It computes how your customer accounts and users use your product, and shows this in the app, in notifications and to your own AI assistant through MCP.
- Atune is a decision-support tool. It gives you data and insight. You decide what to do with it and are responsible for those decisions and their consequences. Atune does not take actions in your business on its own, except for actions you set up yourself, such as an integration or notification. Insight can be incomplete or wrong, for example when the events you send are incomplete. It is not a guarantee, and it does not replace your own judgement.
- AI: Atune does not send your data to an AI provider by default. AI work runs on the AI assistant that you connect, under your agreement with that provider.
- Integrations: when you connect another tool (for example Attio, HubSpot, PostHog, Slack or a webhook), data moves between Atune and that tool on your instruction. Your use of that tool is governed by your agreement with its provider.
- We improve the Service continuously and may change, add or remove features. We give reasonable notice before removing a feature that a paid plan depends on.
5. Plans, limits and price
- Plans. Build is free. Grow and Run are paid monthly plans. Current prices and limits are shown at useatune.com/pricing and in Settings → Billing.
- What is metered. Plans are metered in tracked accounts: distinct customer accounts with at least 3 events in the rolling 30 days. People without an account count as users and do not count toward the limit.
- Over the free limit. If a Build workspace tracks more accounts than its limit, analysis continues for a 7-day grace period. After that, insight and answers are paused until you upgrade or usage falls below the limit. We keep receiving and storing your events, so nothing is lost.
- Price changes. We give at least 30 days' notice of a price increase on a paid plan. The new price applies from your first renewal after the notice period.
6. Payment through Stripe and Link
- Who you buy from. Paid plans are sold through Link, operated by Stripe. Stripe acts as reseller and merchant of record for the purchase. This means the following:
- You pay Stripe, not Atune.
- Receipts and invoices come from Link.
- Your card statement shows the charge as coming from Link, with Atune's name.
- Link's purchase terms apply to the payment itself. These terms govern your use of the Service.
- Price and tax. Prices are in US dollars, excluding VAT. Stripe calculates and adds VAT, GST or sales tax where it applies, based on your location and any VAT ID you give. Stripe also files and pays that tax.
- Renewal. A paid plan renews automatically each month and is charged to your saved payment method until you cancel.
- Upgrades take effect immediately. The difference for the rest of the current period is added to your next invoice. The app shows the amount before you confirm.
- Downgrades take effect at the end of the current period. You keep the higher plan until then, and no credit is given.
- Cancellation. You can cancel at any time in Settings → Billing → Manage subscription, or through Link. Cancellation takes effect at the end of the current period, and your workspace then moves to Build. No credit is given for the remaining part of a period.
- Refunds. Fees already paid are not refunded, except as follows:
- Stripe may refund a purchase within 60 days, for example after a support request through Link or to prevent a chargeback.
- Stripe applies regional cooling-off rights where the law requires them.
- Atune may refund at its discretion.
- Failed payments. If a payment fails, Stripe retries it. If the subscription ends unpaid, the workspace moves to Build.
7. Your data
- You own your data. Events, account data and other content you send to Atune ("Customer Data") belong to you. You give Atune the right to process Customer Data only to provide, secure and support the Service, as described in these terms and the DPA.
- Lawful collection. You are responsible for having a legal basis for the data you send, for informing your users, and for not sending special categories of personal data (health, religion and similar) or payment card data.
- Retention. We keep Customer Data for the life of your workspace. We delete it when you delete the workspace, and data about a single person when you ask us to (Settings → Data and privacy). Backups roll over within 14 days. Details are in the DPA.
- Service data. We use operational data about how workspaces use Atune (counts, errors, feature use) for two purposes only:
- to improve the Service;
- to find and fix faults, including when you ask us for help.
We do not use Customer Data or service data for anything else. We do not sell it, use it for marketing, or use it to train AI models.
8. Acceptable use
You must not:
- send data you have no right to send, or use Atune to track people in breach of law;
- try to access other workspaces, break or probe our security, or reverse-engineer the Service except where the law allows it;
- overload the Service, avoid usage limits, or resell the Service without our written consent;
- use the Service for unlawful, harmful or deceptive purposes.
We may suspend a workspace that breaches this section or puts the Service or other customers at risk. We tell you why and, where possible, give you a chance to fix it first.
9. Availability and support
- We aim to keep the Service available and to fix faults quickly, but we do not guarantee uninterrupted operation. No plan includes an availability level (SLA).
- Support: hello@useatune.com.
- Planned maintenance that may interrupt the Service is announced in advance when possible.
10. Confidentiality
Each party keeps the other's non-public information confidential and uses it only to perform this agreement. This does not apply to information that is public, already known, or that must be disclosed by law.
11. Intellectual property
Atune and its licensors own the Service, the software, the documentation and the Atune brand. You get a non-exclusive, non-transferable right to use the Service while your workspace is active, under these terms. If you send us feedback, we may use it freely.
12. Liability
- The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
- Atune is not liable for decisions you make or actions you take based on the Service, or for their outcomes. This includes lost customers, lost revenue and missed opportunities.
- To the fullest extent the law allows, Atune excludes all liability for loss arising from use of the Service. This covers direct and indirect loss, lost profit, lost revenue, lost data and loss of goodwill.
- Fallback. If liability cannot be excluded under the law, Atune's total liability is limited to the fees you paid for the Service in the 12 months before the event that caused the claim. For a free plan, the limit is NOK 1,000.
- The exclusion and the cap do not apply to gross negligence, wilful misconduct, or other cases where the law does not allow a limitation.
13. Term and termination
- The agreement runs until the workspace is deleted.
- You can delete your workspace at any time in Settings. Cancel a paid plan first. Deletion removes Customer Data as described in section 7 and the DPA.
- We can end the agreement with 30 days' notice, or at once if you materially breach these terms and do not fix the breach within a reasonable time after notice. If we end a paid plan without cause, we refund the unused part of the current period.
- Sections 7, 10, 11, 12 and 15 continue after termination.
14. Changes to these terms
We may change these terms. We give at least 30 days' notice of changes that are material to you, by email or in the app. If you do not accept the change, you can cancel before it takes effect. We keep a record of each version and when it took effect.
15. Governing law and venue
These terms are governed by Norwegian law. Agder tingrett is the agreed venue.
